On April 18, 2023, the European Parliament approved the long-prepared and discussed regulation (regulation) on machinery. This will replace the existing Machinery Directive 2006/42/EC, which aims to increase the level of machinery safety for users and workers in Europe.

The publication of the regulation (regulation) on machinery in the official gazette, which according to information should take place in the summer of this year, will start the so-called preparatory period, which will last 42 months.
The expected transition period has been waived, which means that during the preparation period you will study the new regulation, but you cannot use it.
For industrial enterprises in the EU, it is important to determine a single and key date from which the new regulation (regulation) on machinery will enter into force. From day to day, it will not be possible to refer to Directive 2006/42/EC. The key date is estimated to be the beginning of 2027, subject to the deadline for publication in the gazette.
By approving a preparatory period, instead of a transitional period, there is room for study, training and the preparation of new rules in companies. But not for the application, as the new machinery regulation cannot be applied before a set key date.

 

New rules for machinery


In brief, the new rules will include requirements for the design, construction and testing of machinery, as well as requirements for the provision of machinery safety information to users. The widely discussed term "substantial change in machinery" will be clarified. The regulation talks about the need to introduce a mandatory assessment of the risks arising from the use of so-called "risk groups" of machinery (6 categories of machinery) by an independent third party (notified person). The regulation also introduces electronic documentation for machinery. Digital manuals will become the standard, while printed manuals will be retained for customers who do not have access to a digital copy.
